This spam bubbled up in mid August, 2003. The Dean Campaign may have outsourced an email campaign to Emailresults.net, based on claims by Emailresults.net that the campaign would be opt-in. There was some sort of due diligence failure on the part of the Dean campaign, as a google search on "emailresults.net" shows numerous references to their propensity for spamming on the first two pages of search results.
After the Dean campaign was presented with clear cut evidence as to the nature of emailresponse.net, they investigated promptly and terminated their relationship with the company that same day..

In his State of the Union address, President Bush uttered at least 16 words that were known by some in his administration to be false. I have asked President Bush to answer sixteen questions regarding what he and his administration knew about the forged Niger documents and the false claim that Iraq had attempted to purchase uranium in Africa.
This Administration's looseness with the facts does not end in Iraq. The Bush tax cuts are not about cutting taxes; they are about starving and destroying Social Security, Medicare, and our public schools. They call polluting our air "The Clear Skies Act;" cutting old growth "The Healthy Forest Act;" and taking away our civil liberties "The Patriot Act."
I stood against this President when too many Democrats in Congress were voting to give the Bush administration a blank check to wage pre-emptive war on Iraq. Attacking Iraq was the wrong war at the wrong time, and in recent days it has become obvious that many questions remain about the way President Bush led the American people to war and failed to foresee the continuing resistance that our military is now confronting. These questions should have been asked by Congress before the war, but too many in Washington failed to demand the truth when our nation needed it most.
Too many in my party have failed to stand up to this President?s assault on our ideals. I am not afraid to stand up to President Bush. I stood against his attack on Iraq. I did not support his huge tax cuts. I did not support the misnamed "No Child Left Behind Act," which is raising property taxes all over America and bankrupting our public school system. Unlike all but one of my opponents, I have balanced a budget and I have appointed judges-- and I am the only candidate for the Democratic nomination who has made health care available to 99% of the children and 90% of the adults in my state.
We are going to win this nomination and defeat George W. Bush in 2004, but we need your help. Our campaign has shown that the individual actions of each of us, when united in common cause with the actions of thousands of others, have the power to transform our nation. Emailresults is a known spamhaus. Their exploits are well enough known to rate two listings in the Spamhaus Block List. Those listings are as follows:
Emailresults.net has many "marketing partners", from whom they have obtained many email addresses. Some of the recipients of this spam may actually at one time or another have submitted their email addresses to a Emailresults marketing partner, usually as part of a web page resistration procedure or a software download registration. However, in at least some cases, the transfer of the email address was in clear violation of the privacy policies of the original recipient of the email address.
In the case of Dialpad, one of the aforementioned partners, a statement appears on their website, indicating that for a period of slightly more than three years, they were providing email addresses to partners. However, the one recipient who provided me with a spam citing dialpad indicated that he downloaded the dialpad software in the 1996-1997 timeframe, which is two years before the window claimed in dialpad's privacy notice.
Dialpad's privacy notice says: During the period between October 1999 and January 2003, Dialpad allowed its users to 'opt in' in our registration form to receive promotional emails from Dialpad and our partners. At that time, users were given the ability to 'opt in' and then complete a survey form that asked for specific demographic information. This information has been shared with reputable third parties. If you were a Dialpad user during this time and are receiving emails from any of these partners or from Dialpad and you wish to unsubscribe from their services, please send an email to privacy@dialpad.com and include the email address to which you are receiving email. You will be removed from the Dialpad list as well as the partner databases. You may also follow the instructions contained in any promotional email to unsubscribe from receiving future promotional emails. Any email that is coming to you as a result of your having registered with Dialpad during that period will have a clear and working link to allow you to unsubscribe. If you choose not to opt-in to receive communications from Dialpad, you shall not receive future communications.
I do not yet have a copy of the Dean email which falls into this category, but I have established that one of Emailresult.net's marketing partners is apparently datastreamgroup.com. datastreamgroup.com is none other than Eric Reinertsen, a notorious Florida spammer with an extensive Spamhaus.org ROKSO record. This apparent relationship removes all doubt about the nature of emailresults.net and their business.
